Terms of Service
These terms apply when you use the What’s Their Name iPhone app (“the app”). By using the app, you agree to these terms. Your use is also governed by Apple’s Licensed Application End User License Agreement. If these terms conflict with Apple’s agreement, Apple’s agreement controls.
What the app is for
What’s Their Name is a private memory aid for remembering the names and faces of people you already know. It isn’t a general photo-storage service, and it isn’t a tool for identifying strangers.
Your responsibility
You’re responsible for the names and photos you add. Only add photos you have the right to use, and respect the privacy of the people in them. You’re responsible for complying with the laws that apply to you, including privacy and biometric laws where you live.
What’s not allowed
Don’t use the app for unlawful content or misuse, including:
- child sexual abuse material;
- non-consensual intimate imagery;
- harassment, stalking, or exploitation;
- identifying or tracking people you don’t know;
- anything that violates another person’s legal rights.
Your data
Your Rolodex stays on your devices and in your private iCloud. It belongs to you, and we don’t claim any rights to it. The Privacy Policy explains what’s stored and how to delete it. You’re responsible for keeping backups. We can’t recover data you delete, because we never have a copy.
Purchases
If the app offers paid features or subscriptions, they are sold through the App Store and billed by Apple. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel them in iOS Settings → [your name] → Subscriptions. Apple handles refunds under its own policies.
The app is provided “as is”
We work hard to make the app reliable, but it is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We don’t guarantee that the app will be error-free or uninterrupted, or that data will never be lost.
Limitation of liability
To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for it in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not apply to you.
Ending use
You can stop using the app at any time by deleting it. Because there’s no account, there’s nothing else to close.
Changes to these terms
We may update these terms. When we do, we’ll post the new version here and update the date at the top. If you keep using the app after a change, you accept the updated terms.
